SERIOUS INJURY MAY RESULT IN THIS ACTIVITY. INJURY MAY ALSO RESULT FROM JUST BEING ON THE FARM’S PREMISES. PARTICIPANTS AS WELL AS SPECTATORS MUST BE ALERT AND AWARE OF THEIR SURROUNDINGS AT ALL TIMES. WE DO NOT GUARANTEE YOUR SAFETY.

A. REGISTRATION OF PARTICIPANT(S) AS WELL AS SPECTATORSS AND AGREEMENT PURPOSE – For valuable consideration hereby acknowledged, the following listed individual(s), and the parent or legal guardians on his/her/their behalf, do hereby agree to VISIT THIS FARM WITH FARM ANIMAL(S), use the grounds, AND RELATED activities on today’s date. B. / AGREEMENT- SCOPE- DEFINITIONS: This Agreement shall be legally binding upon me the registered PARTICIPANT(S) AS WELL AS SPECTATORS, and the parents or legal guardians thereof if a minor, my heirs, estate, assigns, including all minor children, and personal representatives; and it shall be interpreted according to the laws of the state and county of THIS FARM’S physical location. The terms “I”, “ME”, “MY” shall herein refer to the above registered PARTICIPANT(S) AS WELL AS SPECTATORS and the parents or legal guardians thereof if a minor.

C. / I UNDERSTAND THAT: NO FARM ANIMAL (S) is completely safe . If a FARM ANIMAL (S) is frightened or provoked it may act according to its natural survival instincts which may include, but are not limited to: Shifting its weight; Kicking, Biting, or Running from danger.

D. / CONDITIONS OF NATURE - I UNDERSTAND THAT: THIS FARM IS NOT responsible for total or partial acts, occurrences, or elements of nature that can scare a FARM ANIMAL (S), , or react in some other unsafe way. SOME EXAMPLES ARE: rain, wind, water, wild and domestic animals, other FARM ANIMAL (S), insects, reptiles, which may walk, run, or fly near, or bite or sting a FARM ANIMAL (S) or person; and irregular footing on uneven ground.

E. / CARRY ON OBJECTS AND SHARP NOISES - I UNDERSTAND THAT: PARTICIPANT(S) AS WELL AS SPECTATORSS must not carry loose items which may fall, blow away, flap in the wind, bounce, or make sharp noises, possibly scaring a FARM ANIMAL (S). SOME EXAMPLES ARE: Cameras, hats not securely fastened under chin, toys, cell phones, and/or purses. PARTICIPANT(S) AS WELL AS SPECTATORSS must not make loud noises, such as screaming or yelling, which may scare a FARM ANIMAL (S).

F. / I AGREE THAT: In consideration of THIS FARM allowing my participation

in this activity, under the terms set forth herein, I, the PARTICIPANT(S) AS WELL AS SPECTATORS, for myself and on behalf of my child and/or ward, OTHER CHILDREN UNDER MY CARE, heirs, administrators, personal representatives or assigns, do agree to hold harmless, release, and discharge THE “FARM”, its owners, agents, employees, officers, directors, representatives, assigns, members, owners of premises and trails, affiliated organizations, insurers, and others acting on its behalf (hereinafter, collectively referred to as “ASSOCIATES”), of and from all claims, demands, causes of action and legal liability, whether the same be known or unknown, anticipated or unanticipated, due to THIS FARM’S and/or ITS ASSOCIATES activities; and I do further agree, I shall bring not claims, demands, action and causes of action, and/or litigation, against THE FARM and/or ITS ASSOCIATES as stated above in this clause, for any economic and non-economic losses due to bodily injury, death, property damage, sustained by me and/or my minor child and/or legal ward in relation to the premises and operations of THIS FARM, to include, handling, otherwise being near FARM ANIMAL(S) owned by or in the care, custody and control of THIS FARM, whether on or off the premises of THIS FARM. Additionally, I recognize that just being on the premises creates a risk of injury and I/we will bring no cause of action related to any injury sustained while being on the FARM’S property.
