BUYER BEWARE:
My fiance (lawyer, works in contracts) reviewed Eric's contract and found some pretty major issues. He agreed on the phone to revise the contract but then sent me an email a few hours later saying he wouldn't "be able to fulfill your requirements for the contract changes." Here are some of the major issues we thought needed to be fixed and my requests: - He could cancel for any scheduling conflict. This could mean that if he got a better offer, etc. he could cancel. I asked him if he'd be willing to narrow down what a scheduling conflict meant to things like family emergencies. - If he did cancel, we would provide a competent professional to photograph our wedding. I asked him if we could set some definition around what a competent professional meant, something quantifiable so I knew I'd be getting the same quality. For example, a certain number of years experience or have photographed a certain number of weddings. - While I don't think this was intentional, the contract said that if he did have to fully cancel on us after we paid him the full amount, he didn't have to refund the money. - The contract did not specify when we would get the images back. He said he was really uncomfortable putting a date in there because sometimes he gets busy. I asked him what the longest amount of time it ever took and he said 2 months. I said "Ok, then how about putting in there that you will get them back to us in 3 months or less?" (giving him even more time than his max to be reasonable). - The contract gave us print permission only, meaning we couldn't post to social media. I asked him to add personal social media. - The contract didn't give us permission to use the photos commercially. I did ask for this and he said no and that's fine. I just wanted to be sure he'd be open to some sort of arrangement later.
It was also quite misleading, as we originally met Eric through Studio Tran and thought we were negotiating a deal with Studio Tran. However, as you can see from above, the contract he provided wasn't for Studio Tran, it was for just him, which felt a bit like bait-and-switch.
