haded grove of trees beside what looked like a general store exactly 3 minutes outside of your wedding venue (I timed it because I wanted to know if it would be a location option for photos). I arrived to your wedding an hour early. I did not go off site to scout the other location. Your venue had minimal areas that would be efficient for your bridal party group photos due to the time of day and for how bright it was at your venue. I told you about the shaded grove of trees that was specifically 3 minutes outside of the venue. I asked you if you wanted to go to that location or if you wanted to shoot in one of the shaded areas at the barn at your venue. You chose to go to the grove of trees outside of the venue. When we arrived, the owner of the store informed us that it was not a store open to the public and that we needed to leave due to there being heavy machinery on the property. I apologized to the owner for the misunderstanding, and I apologized to you for not knowing that it was not a public store. The sign read, "Open.” When someone in your wedding party backed out of the lot, they knocked over a post and did not make it right with the owner nor did anyone try to pay for the damages (to my knowledge). I arrived to your wedding 1 hour early, and I began working 45 minutes earlier than I was contractually held to do so, meaning I worked 10% longer on your wedding day than the time you paid to have me for. To address the breach in contract on my end: I did have a breach of contract in the sense that I was extremely ill for 10 days before your gallery due date. I made you aware that I would need more time to finish up the last details in your gallery. I could have provided you your gallery on time, but the photos would not have been near as polished or as beautiful as they are fully completed. You asked for a 10% reimbursement in which would have amounted to $136.00. After asking for the reimbursement, you were made aware that I provided $416.00 worth of extra photos in your gallery to compensate for the six days in which you waited for your gallery past the gallery deadline. The only thing I possibly did that could have been seen as anything other than professional in any way was being 6 days late with your gallery upload, in which I fully made up for with the $416.00 in extra photos. (I essentially paid you $280 MORE than you asked for as a compensation.) I provided you with 21% more photos than you paid for. I uploaded your gallery on 1/21/23. You emailed me on 1/22/23 stating, word for word, “we are so impressed and in love with our gallery, you have done an amazing job capturing all of the emotions from one of the greatest nights of our lives.” You also stated, “our contract was voided jan. 15 when you were unable to hold up your side of the agreement.” Because of that sentence, I temporarily removed your online gallery to protect my photo rights on 1/22/23. I sent you a request via email to verify if you meant a void of contract vs a breach of contract. I needed to know if you believed our contract to be voided so that I could know if you would respect the photo copyrights agreed upon in our contract or if you would disregard our contract in whole. If you were stating the contract to be voided, you were therefore canceling any obligation I owed you, and therefore, that meant that the photos were not yours to have access to. On 1/23/22, you said you understood that, you said you did not need any kind of extra compensation past the $416.00 in photos, and you verified that you meant a breach in contract and that you would respect all photo copy rights and contractual agreements. Less than 3 hours later at 12:12 pm on 1/23/22, I made your gallery available to you again. You then downloaded your gallery. To speak on contractual breach, you nor your party respected the photography timeline at any point in the day, and I remained kind and helpful to still make sure every photo you wanted to have happened. Your wedding party did not cooperate willingly, forcing me to repeat myself multiple times throughout the day. Two of your family members were degrading and condescending towards me. (Notably, other family members and guests praised me for how wonderful I was.) All three of those occurrences were a breach in contract and could have resulted in me leaving your wedding based on our contractual agreement. I apologized multiple times for being ill; I have now been sick for over a month and have still delivered 4 other galleries. Its just so happens that your gallery due date fell on the days that I was close to hospitalization, and I was bodily unable to finish the last details in time. I do not know any other way to fix that error than what I did: providing you $416.00 in free images. I hope you can find it in your heart to be honest with yourself and others about the ways I was “incredibly unprofessional.”
