We are having to sue Jackie to get a refund. I hired Jackie in 2019 for my 2020 wedding. We fully paid Jackie very quickly after hiring her. Jackie did our engagement photos, which turned out great. On Tue, Nov 12 2019 I asked a question about ...the timeline for golden hour photos and received no response. I emailed again Mon, Jan 27 2020 asking to finalize the timeline, and still got no response. I emailed Jackie again on Thu, Jan 9, 2020, about the timeline with no response. I emailed her a 4th time on Fri, Jan 17 2020, saying “Howdy, I am just sending you this email because I messaged you back in November and didn't get a response I also emailed you on the 9th of this month, so I was just wondering if there was a better way to get in touch with you. Maybe text messaging? I'm not sure if maybe my emails are getting filtered as junk or what's going on. Jackie said she didn't receive any of my emails, but she did respond to this 4th email. My wedding was right at the beginning of the pandemic and Jackie thought it best to get a different person to step in for her since someone in her family was high risk. My wedding was unfortunately canceled anyways. On Wed, Mar 18, 2020, Jackie agreed to a new 2021 date after we confirmed with all our vendors. On August 5th we asked for the contract. One month later on September 6th Jackie said she didn't know we confirmed with our other vendors (which was true, that was my bad for not telling her we were good to go, but you can see the length in-between communication). She said she would send it over on Sep. 11th. We still had no contract. I sent a demand email saying if she didn’t send it we were going to need to part ways. On Sep 12th she sent the 2nd contract. Sun, Dec 27, 2020,I sent an email saying I was going to be 8mo pregnant at the wedding and needed to reschedule again. Mon, Jan 11, 2021 Jackie said she would reschedule again. I sent emails to Jackie on Mon, Feb 22, 2021; Fri, Sep 17 2021; Fri, Jan 28, 2022; an Instagram message that she read, but never responded to asking her to check her email on Feb 3rd; and then a final demand on Feb 22, 2022 at 2:12 PM. She finally responded to me after I stopped being polite and told her ghosting me for a year was unacceptable. She said that she has been unavailable for various reasons, super flexible with us and that she actually lost money getting a replacement during March 2020 COVID. That was her response to her client after a year of her not responding to me. I finally told her we would STILL love for her to be our photographer if she could send an up-to-date contract for the coordinator or we would accept a refund if she didn't want to send the contract. Neither happened. The second contract that Jackie sent stated that she didnt have to refund anything for cancellation, but I dont consider asking for a contract a cancellation. She also verbally agreed to a 3rd date for us. After a verbal agreement I didnt question if Jackie would be our photographer. She should have stated that her contract didnt obligate her to save a 3rd date and said no to us. She agreed to a 3rd date in writting which is binding in TX. Be careful hiring Jackie she could take your payment and then not respond to emails for 12 months and leave you in the dark about whats going on. Just to be clear we gave Jackie a $750 retainer for engagement photos and her services which we are NOT seeking in court. That is absolutely her money.
